What Is a Designated Agency Agreement in BC Real Estate?

If you have recently started working with a real estate agent in Kamloops, you have likely encountered the Disclosure of Representation in Trading Services form. Understanding what this document means, and specifically what designated agency means, is important before you sign anything.

In BC, designated agency is the standard form of representation in residential real estate. When you work with an agent under a designated agency agreement, that agent is legally required to represent your interests loyally and confidentially. They owe you full fiduciary duties: honesty, disclosure of relevant information, and genuine advocacy for your position.

This is different from a transaction brokerage arrangement, where the agent's duties to you are reduced. In a transaction brokerage relationship, the agent facilitates the transaction without providing full advocacy to either party.

Before signing any agreement or beginning substantive work with an agent, BC law requires that they disclose what type of representation they are offering and that you confirm you understand it. This is not a formality. It is a meaningful commitment that shapes everything that follows.

For buyers, designated agency means your agent is working for you, not for the seller and not for the brokerage's transaction volume, but for your outcome. They must disclose anything they know that is relevant to your decision and must negotiate in your interest.

The Kamloops Home Team operates under designated agency for all of our clients, and we take those duties seriously. We will always explain what our relationship means, what we owe you, and how we work before you commit to anything.
